Okell’s Promotion Terms & Conditions

This page provides the terms upon which Heron and Brearley Limited will operate its Okell’s Card Loyalty scheme. If you want to participate in the loyalty scheme,  you will need to collect your Okell’s Loyalty Card from one of our participating pubs and register your card by visiting Heron and Brearley’s website (www.markettowntaverns.co.uk).

During the registration of your Okell’s Loyalty card, you will be required to accept these terms which provide (amongst other things) how you can use your Okell’s Loyalty card at Heron and Brearley’s participating sites to earn any free Okell’s pints.

You should ensure that you have read and understood these terms prior to completing the registration of your Okell’s Loyalty card as these terms will apply to your use of your Okell’s Loyalty card.

If you don’t accept these terms, then you will not be permitted to register your Okell’s Loyalty card, which will mean that you will not be permitted to use your Okell’s Loyalty card or receive any free Okell’s pints.

GENERAL

1.1 The Okell’s Loyalty Card scheme is operated by us, Heron and Brearley Limited (company number 000218C) with its registered office at Old Castletown Road, Kewaigue, Douglas, Isle of Man (H&B).

1.2 Your Okell’s Loyalty card shall at all times remain the property of H&B.

1.3 Scheme valid between 1st October 2020 – 31st October 2020.

1.4 We reserve the right to refuse Okell’s Loyalty membership to any person or to refuse to register any Okell’s Loyalty card or to cancel, to withdraw or to alter these terms or its Okell’s Loyalty scheme at any time and for any reason without prior notice or explanation.

1.5 If we make any amendments to these terms or our Okell’s Loyalty scheme, then such changes will posted online at www.markettowntaverns.co.uk. If we make any amendments to these terms or our Okell’s Beer Card Loyalty scheme and you subsequently use your card, then you will be deemed to accept such changes.

1.6 Your Okell’s Loyalty card is provided to you for your personal use in relation to consumer purchases only and business or corporate use is not permitted.

1.7 If you want to cancel your Okell’s Loyalty card or your Okell’s Loyalty membership, then you should send an email to feedback@hb.im requesting cancellation or return your Okell’s Loyalty card to any of our participating sites along with a signed and dated written cancellation letter.

MEMBER REQUIREMENTS

2.1 If you want to become a Okell’s Loyalty member, then you need to be aged 18 years or over at the time of registration of your Okell’s Loyalty card and you will need to provide a valid email address. If you do not provide a valid email address, then your Okell’s Loyalty card registration will be unsuccessful.

2.2 An individual can only hold one Okell’s Loyalty card and only one email address can be registered per Okell’s Loyalty card.

2.3 We reserve the right to refuse, merge or close (at its sole discretion) any additional or duplicated Okell’s Loyalty memberships or any Okell’s Loyalty cards at any time.

CARD REGISTRATION

3.1 Your Okell’s Loyalty card must be registered with us before you can record and redeem any free Okell’s pints. To register your Okell’s Loyalty card please visit our website (www.markettowntaverns.co.uk).

3.2 Once you have registered your Okell’s Loyalty card and activated your Okell’s Loyalty membership it is your responsibility to notify us of any changes to your personal details as soon as possible following any change by sending details of the change by email to feedback@hb.im

CARD USE

4.1 It is your responsibility to ensure that your Okell’s Loyalty card is used in accordance with these terms.

4.2 Offer only available on Okell’s Bitter, MPA or Seasonal Cask at participating sites. The Okell’s sales that are recorded on your Okell’s Loyalty card are for your use only and are non-transferrable.

4.3 Please note that your Okell’s Loyalty card is not a cheque guarantee, debit or credit card and any Okell’s free pints that you receive do not have any monetary value and cannot be exchanged for cash.

4.4 If your Okell’s Loyalty card is lost or stolen, then it is your responsibility to notify us by sending an email to feedback@hb.im so that we can cancel your original Okell’s Loyalty card and issue a replacement card to you.

4.5  If we receive notification that your Okell’s Loyalty card has been lost or stolen, then your Okell’s Loyalty sales balance will be transferred to your replacement card.

4.6 Your Okell’s Loyalty card will not be accepted as a valid form of personal identification or proof of age by us.

4.7 Only one Okell’s Loyalty card may be used per transaction that you undertake.

4.8 1 transaction purchased equates to 1 swipe of the card.

4.9 Your Okell’s Loyalty card may not be used in conjunction with any other offer or on a specially priced menu unless specifically stated by us.

5.0 If you breach these terms, then we shall be entitled to terminate your Okell’s Loyalty membership and your Okell’s Loyalty card without notice. If your Okell’s Loyalty card is terminated, then any Okell’s Loyalty sales that have been accumulated on your card will be automatically cancelled and you shall not be entitled to any compensation whatsoever.

5.1 Your Okell’s Loyalty card does not override the right to refuse service which states that our staff team have the right to refuse service and to request you to leave the premises.

HOW YOUR OKELL’S LOYALTY SALES ARE ACCRUED

5.1 To qualify for a free pint of Okell’s, you need to have bought 5 pints of Okell’s between the promotion dates of the 1st October 2019 and the 31st October 2020 at any of our participating sites.

5.2 If you purchase a Okell’s pint at one of our participating sites but you do not present your Okell’s Loyalty card when settling your bill, then you will not be entitled to earn a Okell’s Loyalty sale and no Okell’s Loyalty sale will be recorded on your Okell’s Loyalty card in relation to that transaction.

5.3 If Okell’s Loyalty sales are recorded on your Okell’s Loyalty card in relation to a purchase of qualifying H&B products that is subsequently fully or partially refunded by us, then the corresponding Okell’s Loyalty sales will be deducted from your Okell’s Loyalty card.

5.4 1 pint of Okell’s purchased in participating sites equates to 1 swipe of your Okell’s Loyalty Card, enlisted the Okell’s sale onto your account.

HOW YOUR FREE PINT OF OKELL’S IS REDEEMED

6.1 You can redeem your free pint of Okell’s during any transaction at any of our participating sites on presentation of your Okell’s Loyalty card at the time of the transaction. Although your Okell’s Loyalty sales do not have any monetary value, once you reach the set milestone of 5 pints, you will be eligible to redeem your free pint of Okell’s.

6.2 The Okell’s Loyalty sales will not be recorded on your Okell’s Loyalty card and the free pint of Okell’s cannot be redeemed unless your Okell’s  Loyalty card has been registered with us.

6.3 Your free pint of Okell’s can be redeemed in any of our participating sites.

6.4 Your free pint of Okell’s can only be redeemed once and will be automatically deducted from your Okell’s Loyalty card once redeemed.

6.5  The Okell’s Loyalty scheme will be active from 1st October until the 31st October 2020. At this point, any Okell’s Loyalty sales that are recorded on your Okell’s Loyalty card will be cancelled.

H&B’S PARTICIPATING SITES

The Okell’s Loyalty scheme only operates at our participating sites. These are all 11 of our Market Town Taverns. If you present your Okell’s Loyalty card in relation to transactions at any of our sites that is not a participating site, then you will not be entitled to earn any Okell’s  Loyalty sales or redeem any free pints of Okell’s in relation to such transactions.

YOUR PERSONAL INFORMATION

9.2  To make things easier, however, we have set out below some of the things that we may do with your personal information but this is not a full list.

9.4 What information will we use?

If you become a Okell’s Loyalty member, then we will collect and use your personal information. For example, this would include your registration details (e.g. name, email address, etc.), information about your use of your Okell’s Loyalty card. 9.5 How will we your information?

We will use your information to track, monitor and protect your Okell’s Loyalty sales. Your information will also allow us to tailor our future promotions to better suit you.  For more information, click here to see our privacy policy.

9.6 Who will we share your information with?

Your information will be collected by us and will only be shared to companies within the H&B group of companies. For more information, click here to see our privacy policy.

9.7 If you choose the ‘email opt in’ option during the registration of your Okell’s Loyalty card, then you will receive emails from us and our group companies about H&B’s products and services, future promotional offers, H&B news and updates.

9.8 If you chose the ‘email opt in’ option but no longer wish to receive emails from us, then you will need to send an email to unsubscribe@pubsandbars.im or you can click on the unsubscribe link provided within each email that you receive from us.

9.9 Your rights

You have a number of rights under applicable data protection law and the GDPR (General Data Protection Regulation). These include, amongst other things, the right to receive a copy of the personal data we process about you for no charge, the right to have your personal data amended, rectified or erased, the right to object to processing of your personal data and the right to data portability and also the right to lodge a complaint with the relevant supervisory authority, which for the UK is https://www.inforights.im/. LEGAL

10.1 These terms are between you (in your capacity as a Okell’s Loyalty card holder) and H&B and no other person shall have any rights to enforce any of these terms in relation to your Okell’s Loyalty card.

10.2 Any dispute between you and H&B or any claim arising out of or in connection with your use of your Okell’s Loyalty card or these terms or their subject matter shall be governed by and construed in accordance with Isle of Man law and the courts of the Isle of Man shall have exclusive jurisdiction in relation to such matters.
